Background:

Following the running of Race 10, the ‘Celebrate Xmas at the Races 7 December Rating 68’ an Information was lodged alleging a breach of Rule 638(3)(f)(iii). The Information read as follows:

‘in that she used her whip on a runner when out of contention of finishing in the first 5 placings’.

Rule 638(3)(f)(iii) provides .. (f) a Rider must not use his or her whip (iii) when the Rider’s horse is out of contention of finishing in the first five placings;

Prior to commencement, Ms Satherley asked that she be excused from attending the hearing. Ms Satherley was able to confirm to the Adjudicative Committee that she had been fully briefed by Stewards (including viewing available film), understood the nature of the charge, had read and signed the Information and admitted the breach. It was on this basis that she was excused and the hearing took place.

Evidence:

Using available film, Stewards identified the incident. As the field entered the home straight (400m), PERSPECTIVE was situated to the rear of field approximately 10 lengths from the leader. Approaching the 200m mark, the horse had not improved. The Respondent is seen to strike her mount on three occasion between this point and the 100m point. The horse did not respond to being hit.  PERSPECTIVE finished in 10th position,10 lengths from the winner and 5.4 lengths from the 5th placed horse.

Decision:

As the charge was admitted, it was deemed proved.

Submissions as to Penalty:

Stewards advised the Respondent’s record. Her record does remain clear, as it relates to any breach of this Rule within the last six months. In extending this, it was noted that she had received a warning in relation to this Rule earlier in the day (Race 4). Ms Satherley has had 349 rides over the last year. The Adjudicative Committee was referred to the current Penalty Guide.

Reasons for Penalty:

Film identifies the breach. The current Penalty Guide provides for starting point of a $300 fine for a breach of this Rule, 1st offence. On balance, the Adjudicative Committee found no compelling reason to deviate from the Guide. A fine of $300 was determined to be the appropriate penalty.

Conclusion:

Jockey Ms Lynsey Satherley is fined a sum of $300.
