FACTS
Ms Satherley, the Rider of “JODELIN GAL” admitted a breach of Rule 638(3)(g)(i) in that she struck her mount 7 times prior to the 100m.
Ms Satherley advised the Committee that she understood the Rule, Charge and confirmed that she admitted the breach.
Film replays clearly showed that Ms Satherley had struck her mount 7 times prior to reaching the 100m. Her mount “JODELIN GAL” won the Race by a half-head.
Ms Satherley said that she forgot that she had hit her mount on the corner (first strike) and added that it was an error in counting.
DECISION
As the charge was admitted plus the film evidence, the charge was proved.
PENALTY SUBMISSIONS
Mr Oatham said that Ms Satherley had two whip breaches on 11 December 2021 resulting in a 5-day suspension and a 7-day suspension plus a $250 fine in a Group 3 event. Mr Oatham referred to the Penalty Guide and said an aggravating factor was that Ms Satherley’s mount won the race by a half-head.
Ms Satherley asked that any suspension imposed start after 11 June 2022.
REASONS FOR PENALTY
Having regard to the record, Penalty Guide and that Ms Satherley’s mount went on to win the race narrowly, a 5-riding day suspension and a fine of $500 was considered to be the appropriate penalty.
PENALTY
Ms Satherley’s Jockey’s Licence was suspended from 11 June through to and including Racing on 18 June 2022 with a $500 fine imposed.
