Evidence

Following the running of Race 2, the Respondent, Class A Rider Mrs L Satherley admitted a charge alleging excessive whip use prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Senior Stipendiary Steward, Mr Jones demonstrated that the Respondent struck her mount six times from the straight entrance to the 100-metre mark.

Mrs Satherley agreed with the number of strikes and had nothing further to add.

Decision

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions For Penalty

Mr Jones produced the Respondent’s record which indicated one previous breach in the preceding 6 months. This occurred on 11 March 2023. He also identified that prior to that breach, Mrs Satherley breached the Whip Rule on 8 October 2022. By agreement it was determined that this ‘dropped off’ on today’s date as it occurred 6 months to the day and therefore the reset provisions apply.

Stewards submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use (as of 1 March 2022) – namely a $250 fine.

The Respondent provided no submissions as to the penalty.

Reasons For Penalty

The Penalty Guide starting point for a second breach involving one strike more than permitted is a fine of $250.

After considering the film evidence, the submissions and having due regard for the number of strikes the Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide.

On that basis the Respondent is fined $250.

Conclusion

Rider, L Satherley is fined $250.
