Introduction

This charge arises from the meeting held at the Matamata RC on Saturday 8 October 2022. The Information was filed and adjourned due to Mrs Satherley having left the course.

The charge was subsequently dealt with at the Avondale JC meeting on Wednesday 12 October 2022.

Evidence

Following the running of Race 12, at Matamata RC on 8 October 2022, Information No. A17239 was filed alleging a breach of Rule 638(3)(g)(i), in that Rider Mrs L Satherley struck her mount (LA PALMA) six times prior to the 100-metre mark.

At the commencement of the hearing, at Avondale on 12 October 2022, Mrs Satherley admitted the charge.

Decision

As the Respondent admitted the charge, the Adjudicative Committee deems it to be proved.

Summary of facts

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Stipendiary Steward Mr Jones identified LA PALMA (L Satherley) which was racing adjacent to the running rail. He demonstrated that Mrs Satherley struck her mount 6 times from the straight entrance to prior to the 100-metre mark.

In response, Mrs Satherley had nothing to add.

Penalty submissions

Mr Jones submitted that Mrs Satherley has had 3 breaches of this Rule in the past 6 months, namely on 6 June 2022 – $250 fine, on 13 July 2022 – $500 fine and 5 riding days’ suspension and on 30 July 2022 $500 fine. On this occasion, as per the Penalty Guide, Stewards sought a $500 fine plus a 2-day suspension.

In response, Mrs Satherley sought a deferment to any proposed suspension until after racing on 19 October 2022. She had nothing further to add in terms of penalty.

Reasons For Penalty

The Penalty Guide provides for a $500 fine plus 2-day suspension for a fourth breach of this Rule. After considering the film evidence, the submissions and having due regard for the number of strikes, the Adjudicative Committee determined it appropriate to impose a penalty consistent with the Penalty Guide. On that basis Mrs Satherley is fined $500 and suspended for two national days, and her request for a deferment is granted.

Conclusion

The Respondent Mrs Satherley is fined $500 and her license to ride in races is suspended for 2 days, commencing after racing on 19 October 2022 until after racing on 21 October 2022.
