Evidence:

Following the running of Race 3 the PROPERTY BROKERS TAUMARUNUI 1400, Mr Jones presented an Information charging Mrs L Satherley with a breach of Rule 638(3)(g)(i) in that she struck her mount DIGGER 6 times prior to reaching the 100 metre point.

Mr Dooley illustrated from the race film that DIGGER, ridden by Mrs Satherley, was in a challenging position at the 400 metre point and was struck 6 times from there to the 100 metre point, weakening to finish 7th.

Decision:

As Mrs Satherley admitted the charge, it was deemed proved.

Submissions for Penalty:

Mrs Satherley has had 2 breaches of the Whip Rule in the past 6 months (on 6 June 2022, 13 July 2022) for which fines of $250, and $500 plus 5 riding days’ suspension, were imposed.  She made no submissions as to penalty and accepted that she had to incur a fine.

Reasons for Penalty:

Given Mrs Satherley’s history of breaches of this Rule, a significant fine is necessary.

Conclusion:

Accordingly, Mrs Satherley is fined $500.
