SUMMARY OF FACTS:

Following Race 8 Ms L Satherley the Rider of “LOWRY” in the Group 3 Waikato Cup, admitted a breach of Rule 638(3)(g)(i) in that she struck her mount more than 5 times prior to the 100m with her whip.  It was alleged that she struck her mount 6 times when the limit is 5.

Ms Satherley confirmed that she understood the Rule and the charge.

EVIDENCE:

Film replays were shown and it was clear that Ms Satherley had used her whip 6 times on her mount prior to the 100m.  Her mount “LOWRY” finished 3rd earning $9,000.

REASON FOR DECISION:

As the charge was admitted along with the film evidence, it was found proved by the Adjudicative Committee.

SUBMISSION FOR PENALTY:

Mr Oatham said that the breach was now the 6th within the last six months, which was of concern.  Mr Oatham referred to the Penalty Guide and asked that the Adjudicative Committee also consider that it was a Group 3 event.

Ms Satherley said that there was not much she could say.

REASON FOR PENALTY:

The second breach of the Rule on the same day was of real concern to the Adjudicative Committee.

Ms Satherley’s multiple breaches of the Whip Rule are inexcusable and give rise for an uplift in penalty.

The Committee determined that a 7-Riding Day suspension and a fine of $225 was a condign penalty.  The fine being 50% of Ms Satherley’s share of the prizemoney won by her mount “LOWRY” (3rd).

CONCLUSIONS:

Ms Satherley’s Jockey’s Licence was suspended from the end of racing on 19 December through to the close of racing on 31 December 2021 and a fine of $225 was imposed.
