SUMMARY OF FACTS:

Following Race 8 (VALACHI DOWNS FOXBRIDGE PLATE GROUP 2) Ms L Satherley was charged with careless riding.  It was alleged that she allowed her mount SUPREME HEIGHTS to shift out when not sufficiently clear of IRISH GIRL (T Thornton) which clipped a heel and blundered passing the 350m.

EVIDENCE:

Mr Robinson showed the film replays and said that Ms Satherley came out across SUPREME HEIGHTS when not clear and that SUPREME HEIGHTS clipped a heel and blundered.

Ms Satherley in essence said that she mistakenly came out too soon and that MsThornton had to check.  She did not believe that SUPREME HEIGHTS clipped a heel and blundered, rather turned its head out away from her horse and was checked.

SUBMISSION FOR PENALTY:

Mr Jones said that the record showed that Ms Satherley had two prior breaches under the Rule in the last 12 months, those being 17.10.20 – 4 days suspension and 13.03.21 – 4 days suspension & $500 fine.

Mr Jones placed the carelessness low to mid-range.

Ms Satherley agreed with the record and asked that any suspension commence after racing on 11 September 2021.

REASON FOR PENALTY:

The Committee found that near the 350m Ms Satherley did shift her mount out when a little over a length clear.  It could be seen that Ms Thornton was required to check and turn her horse’s head outwards to lessen the interference.

It was not clear that SUPREME HEIGHTS had clipped a heel and blundered nevertheless it was very clear that interference had taken place.

The starting point for mid-range careless riding is 7 days suspension and for low-range 5 days suspension.  An increase of one day was given due to it being a Group 2 event with a minor discount being given for the admitted breach.

CONCLUSIONS:

Considering all matters in relation to penalty it was determined that Ms Satherley’s Jockey’s License be suspended from the end of racing on 11 September to 19 September 2021 inclusive (5 riding days).
