Penalty: Apprentice Jockey Joe Kamaruddin is suspended for 5 National Riding Days

EVIDENCE:

Following the running of Race 7, Mr Jones presented an Information charging Mr Kamaruddin with careless riding in breach of Rule 638(1)(d).

It was contended that near the 400 metre point in the home straight, Mr Kamaruddin directed his mount “JAFFIRA” outwards where there was insufficient room to do so and made contact with “SHANLORD”.

Mr Oatham demonstrated from the race films the careless riding of Mr Kamaruddin. As the field reached the point of the turn at the 400 metre mark, Mr Kamaruddin angled out, from a position towards the rear and near the inside, seeking to mount a run on the inside of “SHANLORD” which was inconvenienced.  In doing so, he came into contact with that horse as there was no clear run available to him.

Mr Harris, on behalf of Mr Kamaruddin, expressed the view that the breach occurred only because the Rider should have been more patient and waited for a few seconds.  The gap was available but the angle of the outward momentum of “JAFFIRA” caused it to make contact with “SHANLORD”.

DECISION:

As Mr Kamaruddin admitted the breach, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Kamaruddin is a very busy Apprentice Rider with a good record of only 2 breaches of this Rule in the past 12 months, in January and March of this year.

REASONS FOR PENALTY:

The careless riding on this occasion was in the low/mid range.  A term of suspension is necessary, and it is fixed taking into account those factors.

Mr Kamaruddin has committed riding engagements up until 8 October 2022, and he is entitled to a deferment of the commencement of the suspension.

CONCLUSION:

His licence to ride is suspended for 5 National Riding Days to commence at the conclusion of racing on 8 October 2022, and to end at the conclusion of racing on 15 October 2022.
