SUMMARY OF FACTS:
Following Race 5 Ms L Satherley the Rider of “MORE WONDER” admitted a breach of Rule 638(3)(g)(i) in that she struck her mount more than 5 times with the whip prior to the 100m. It was alleged that she struck her mount 6 times when the limit is 5.
Ms Satherley confirmed that she understood the Rule and the charge.
EVIDENCE:
Film replays were shown and it was clear that Ms Satherley had struck her mount 6 times prior to the 100m.
Ms Satherley said that she made a mistake and as she was wide on the track she could not really see the 100m.
REASON FOR DECISION:
As the charge was admitted together with the film evidence, it was found proved by the Adjudicative Committee.
SUBMISSION FOR PENALTY:
Mr Oatham said that the record showed that Ms Satherley had breached the Whip Rule on four previous occasions in the last 6 months. He referred to the Penalty Guide and added that in his opinion today’s breach was at the low-end.
REASON FOR PENALTY:
Taking into account Ms Satherley’s record, the Penalty Guideline and the admitted breach, the Adjudicative Committee determined that a 5-Riding Day suspension was a suitable penalty.
CONCLUSIONS:
Ms Satherley’s Jockey’s Licence was suspended from the end of racing on 11 December through to the close of racing on 19 December 2021.
