EVIDENCE

Following the running of Race No 8, the James Bell Holdings Rangitikei Gold Cup, Mr Davidson presented and Information charging Ms Hercock, the rider of “NO LOITERING” with a breach of the excessive use of whip Rule 638(3)(g)(i), in that she struck her mount with the whip more than 5 times prior to the 100 metre mark.

Ms Hercock admitted the breach.

The race films illustrated that when in the home straight Ms Hercock struck her mount with the whip 6 times prior to reaching the 100 metre mark.

Ms Hercock said she had made a “counting mistake”.

DECISION

As the breach was admitted it was found proved.

SUBMISSIONS ON PENALTY

Mr Davidson said that this breach was at the lowest level, being one strike over the imposed limit. Ms Hercock had a clear record, over the past 6 months for any breach of this Rule.

Ms Hercock accepted that a fine was required.

REASONS FOR PENALTY

This was a Listed Race and Ms Hercock’s mount was unplaced, officially finishing 10th  a warning was not appropriate because of the status of the race.

CONCLUSION

Ms Hercock was fined $250.
