SUMMARY OF FACTS:

Following the running of Race 6, the Norwood Manawatu Handicap 1400, Mr Neil Goodwin, Stipendiary Steward, presented an Information charging Mr M Singh, the Rider of MY FATHER’S GUN, with a breach of Rule 638(3)(g)(i), of excess use of his whip in striking his mount excessively in the home straight.

SUBMISSIONS:

The race films illustrated that Mr Singh struck his mount with the whip 6 times in the home straight prior to reaching the 100 metre mark.  The maximum number of strikes permitted is 5.  MY FATHER’S GUN finished in third place.

REASON FOR DECISION:

As Mr Singh admitted the charge, it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Goodwin referred to the Revised Penalty Guidelines for Improper Whip Use issued under Rule 106 which came into force on 1 September 2021.  Mr Singh has never before faced a charge of breaching the Whip Use Rule.

Mr Singh accepted that he had to incur a fine.

REASON FOR PENALTY:

For a first offence of breaching this Rule, the starting point is the greater of a $250 fine or 50% of the Jockey’s share of the stake, if any, earned.  Mr Singh’s percentage was $54.

CONCLUSIONS:

Accordingly, Mr Singh is fined $250.
