Penalty: Jockey Madan Singh is fined $400

Background:

Following the running of Race 7, the ‘James Bull Rangitikei Cup’, an Information was lodged alleging a breach of Rule 638(3)(f)(ii).

Details are as follows:

‘in that he used his whip with an action which raised his arm above shoulder height’.

Mr Singh confirmed to the Adjudicative Committee that he understood the Rule and admitted the charge.

Rule 638(3)(f)(ii) provides

(f) … in a Flat Race or Jumping Race … a Rider must not use his or her whip:

(ii) using an action that raises the Riders arm above shoulder height;

Evidence:

Using available film, Stewards identified the incident. As the field entered the home straight, the Respondent is seen to strike his mount on one occasion with the action commencing with his shoulder raised above his shoulder. The Respondent confirmed that he agreed with Stewards’ interpretation of the incident.

Decision:

As the Respondent acknowledged the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

Stewards outlined the Respondent’s record as it relates to any breach of this Rule within the last six months. There was one breach noted, namely Wairarapa RC on 6/2/2024 – 3 strikes  – $350 fine. Stewards referred the Adjudicative Committee to the NZTR Penalty Guide, which provides a starting point of a $250 fine for 1st breach and recommended an uplift to reflect a 2nd offence.

Reasons for Penalty:

The breach is clearly identified by available film. A starting point of a $250 fine was adopted, with an uplift required to reflect a 2nd offence, along with the status of the event (Listed Race). A fine of $400 was deemed the appropriate sanction.

Conclusion:

Jockey Mr Madan Singh is fined a sum of $400.
