Background:

Following the running of Race 1 the ‘Prestidge Electrical Ltd Maiden 1600’ Respondent Madan Singh admitted a charge of careless riding filed pursuant to Rule 638(1)(d).

Details of the alleged breach are as follows:

‘in that M Singh (Maggiesclan) shifted outwards near the 600 metres when not sufficiently clear of Boomtown Boy (L Sutherland) which was checked’.

Rule 638(1)(d) provides: A rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Mr Singh confirmed to the Adjudicative Committee that he understood the Rule and that he admitted the breach.

Evidence:

Using available film, Stewards demonstrated the incident and horses involved.

Approaching the 600 metre mark, MAGGIESCLAN is positioned mid field against the fence. BOOMTOWN BOY (Ms Sutherland) is behind with THE UGLY SISTER (Mrs Allpress), just forward and 1 out from MAGGIESCLAN. At this point, Mrs Allpress looks to improve the position of her mount, with Ms Sutherland looking to follow. As Ms Sutherland moves, Mr Singh, in an error of judgement, moves out, causing a check to Ms Sutherland’s mount.

Decision:

As the Respondent admitted the charge, it is deemed proved.

Submissions for Penalty:

Stewards contended that the breach represented a low range careless ride and referred the Adjudicative Committee to the current NZTR Penalty Guide. In respect of record, it was noted the the Respondent has had two 2 breaches of  this Rule within the last twelve months namely, Woodville 27/12/2022 – 7 days suspension and Otaki 14/7/2023 – 4 days suspension. Mr Singh has had 184 race day rides in that period. Mr Singh sought deferment of any suspension to satisfy riding engagements at Waverley on 12/10/2023.

Reasons for Penalty:

After consideration, the Adjudicative Committee determined Mr Singh’s carelessness to sit low range. The primary cause of the check to BOOMTOWN BOY is MAGGIESCLAN moving out when insufficiently clear.  A 5 suspension was adopted as a starting point, with a 1 reduction applied to reflect record, along with ready admission of the breach.

Conclusion:

The Respondent’s request for deferment is granted with his Licence to ride in races suspended from the close of racing on 12/10/2023, up to and including 19/10/2023 – 4 national riding days.
