Penalty: Jockey Brett Murray fined $300

Evidence:

Stewards charged Mr Brett Murray with excessive use of the whip following his ride on IT’S SO EASY in Race 4. The Information alleged that Mr Murray used his whip in the home straight eight times prior to the 100 metres mark. Mr Murray admitted the breach and appeared at the hearing.

Mr Davidson, with the use of the videos, stated that Mr Murray used his whip approximately six times between the 350 metres mark and about the 200 metres mark. There was a short respite before Mr Murray struck his horse twice just prior to the 100 metres mark. He said Mr Murray’s use of the whip was excessive and in breach of the Rule.

Mr Murray accepted the evidence as given by the Stewards.

Reason for Decision:

Mr Murray admitted the breach and it is found proved.

Submission for Penalty:

Mr Davidson said Mr Murray had a clear use of the whip record over the past six months. He said Mr Murray has had a poor record in the past but had improved his whip action. He said his use of the whip on this occasion was at the lower end of the scale and he sought a fine of $300.

Mr Murray agreed with the Steward’s submissions.

Reason for Penalty:

Mr Murray use of the whip was excessive in number only and is at the bottom of the scale. Taking into account his excellent record over the past six months a fine at the low end of the scale is appropriate.

Conclusions:

Mr Murray is fined $300.
