EVIDENCE:
Following the running of Race 5, Mr Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider, Mr Brett Murray.
Mr Murray stated he understood the Rule, the Charge and confirmed he admitted the breach.
Mr Davidson played the final straight video to identify Mr Murray leading the field into the straight and counted 9 strikes before the 100m.
Mr Murray agreed with the count and said he misjudged his ride.
DECISION:
The Respondent having admitted the breach it was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson said Mr Murray had a previous breach at Oamaru on 26 July 2023 and was fined $250. Mr Davidson said as per the Guidelines a suspension is in order.
Mr Murray made no submissions for Penalty but said he had confirmed rides at Gore on Wednesday 25 October.
REASONS FOR PENALTY:
The Penalty Guide provides for a second breach, a 5+ day suspension for 4 or more additional strikes.
The Adjudicative Committee, with consideration of Mr Murray’s inevitable frank admission and the testing long home straight, conclude a 5-day suspension is appropriate in the circumstances of this case.
PENALTY:
Deferment is granted and Jockey, Brett Murray is suspended from the conclusion of racing on 25 October 2023 up to and including racing on the 2 November 2023.
