Penalty: Jockey Brett Murray is fined $250

Mr Davidson alleged that in Race 7, Mr Murray struck his mount CHOUX MACHER 6 times prior to the 100 metres.

Mr Oatham demonstrated on the videos that the Respondent made a run in the home straight down the outside of the track and, in so doing, he struck his mount CHOUX MACHER 6 times before the 100 metres. The horse finished second.

Mr Murray said he had just “overcooked it”. The horse was in contention and was responding to his urgings.

Decision

As Mr Murray has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record which showed 1 previous breach in the past 6 months, on 16 March. He submitted that a penalty in accordance with the RIB Penalty Guide was appropriate.

Mr Murray accepted this.

Reasons for Penalty

Mr Murray has struck CHOUX MACHER 6 times prior to the 100 metres. The NZTR Guidelines provide for a penalty of $250 where there is 1 additional strike, and the Jockey has a previous breach in the past 6 months.

Conclusion

Mr Murray is fined the sum of $250.
