Penalty: Jockey, Brett Murray fined $250

Evidence:

The Applicant, Stipendiary Steward, Mr M Davidson filed an Information pursuant to Rule 330(3)c) alleging that Class A Rider, Mr Brett Murray failed to make the contracted weight for his mount MAMMA SANS in Race number 3.

The Respondent was present at the hearing and confirmed his  admission of the breach.

Rule 330(3)(c) provides:

“A Rider shall not fail to ride a horse at the weight at which it is handicapped to carry”. 

Mr Mr Davidson advised that MAMMA SANS was handicapped to carry 54 kg and that at weight out, the Respondent was 1.1 kg overweight. Mr Davidson explained that Mr Murray was replaced by Class A Rider, Mr Terry Moseley, on MAMMA SANS.

By way of explanation the Respondent said that he had been in the sauna all morning but still struggled to achieve the 54kg. He added that he had made a mistake in taking a ride at the 54kg level and had no excuses.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submission for Penalty:

Mr Davidson said that this is the Respondent’s 3rd breach of the Rule within the last 4 months.

  • Riverton-$200 fine for 1 ride over weight
  • Waimate-$250 fine for 2 rides over weight

Mr Mr Davidson stated the breach could be dealt by way of a fine and submitted that a fine of $250..

The Respondent agreed that a fine would be an appropriate penalty .

Reasons for Penalty:

The Adjudicative Committee considered the submissions and determined that after taking all factors into consideration including Mr Murray’s record, his admission of  the breach and some guidance from previous penalties for similar breaches, that a fine of $250 was an appropriate penalty in this case.

The Adjudicative Committee determined that a $250 fine is an appropriate penalty.

The Respondent is fined $250.
