Background

Following the running of Race 1 Henderson Livestock, an Information was filed by Stipendiary Steward Miss R Haley, alleging that Respondent Jockey Brett Murray (Class A Rider) having ridden MY TARNZ GIRL in the race, weighed in at 0.7 kilograms in excess of which he weighed out.

The Respondent acknowledged that he understood the Rule and confirmed admission of the breach.

Rule 648 provides

(5)(a)  If a rider of a horse weighs in at a weight of 0.5kgs or more in excess of the weight at which he weighed out that rider commits a breach of the rules.

Evidence

Stipendiary Steward Mr Oatham said that upon weighing in, following Race 1 on his mount MY TARNZ GIRL, the Respondent weighed in 0.7 kg in excess of the weight at which he weighed out at.

Mr Murray stated that he had taken a drink of water after weighing out, and also that the sponge underneath the saddle may have absorbed some of the horse’s sweat. He offered no further explanation.

Decision

The charge was admitted by the Respondent and is therefore deemed proved.

Submissions for Penalty

Miss Haley stated that Mr Murray had been fined for a previous breach of this Rule at the Canterbury Jockey Club on 6 August 2022 and that she would be seeking an uplift of penalty.

Mr Murray had no submissions on penalty.

Reasons for Penalty

The Adjudicative Committee, after having considered the submissions, believed an uplift of penalty was appropriate due to this being the second offence within the past 2 months.

Conclusion

Jockey Brett Murray was fined the sum of $300.
