SUMMARY OF FACTS:

Following Race 3 Mr Joe Kamaruddin was charged with using his whip forward of the shoulder when riding ANGELICA over the concluding stages.

EVIDENCE:

Film replays were shown with Mr Oatham pointing out where Mr Kamaruddin had struck his mount 3 times forward of the shoulder in the run down the final straight.

Mr Kamaruddin and Mr Harris who assisted Mr Kamaruddin, agreed with the Stewards’ interpretation.

REASON FOR DECISION:

Due to the charge being admitted and the conclusive film evidence, the charge was found proved.

SUBMISSION FOR PENALTY:

Mr Oatham said that Mr Kamaruddin had breached the Whip Rule on two occasions within the last 6 months, those being on 22 June 2021 ($300 fine) and 7 August 2021 ($500 fine).  Mr Oatham said that today’s breach was a different section of the Rule and that the Stewards would not be uncomfortable if a monetary penalty was imposed.

Mr Harris said that Mr Kamaruddin was trying too hard and that the strikes were not aggressive.  He said that he just needs to slow down a little, as he presently over-rides his mounts.

Mr Kamaruddin agreed with Mr Harris’ comments.

 REASON FOR PENALTY:

Taking into account all submissions and the record, it was determined that a fine was a condign penalty. 

CONCLUSIONS:

Mr Kamaruddin was fined $650.
