FACTS

Ms Hercock, the Rider of “CHASE” admitted a breach of Rule 638(3)(g)(i) in that she struck her mount 6 times prior to the 100m (5 is the limit).

Ms Hercock advised the Committee that she understood the Rule, Charge and confirmed that she admitted the breach.

Film replays showed Ms Hercock striking her mount 6 times before reaching the 100m.

DECISION

As the charge was admitted together with clear film evidence the charge of excessive whip use was upheld.

PENALTY SUBMISSIONS

Ms Algar said that on 21 May 2022 Ms Hercock was fined $250 after breaching the Rule in a Listed Race.  She said normally a warning is imposed for a first breach but as the breach occurred in a Listed Race a charge was preferred.  She suggested that today’s breach be dealt with by way of a first offence.

Ms Hercock confirmed her record and said that her whip riding had improved.

REASONS FOR PENALTY

Taking into consideration all matters in relation to penalty including the Penalty Guide, a fine of $250 was deemed appropriate.

Ms K Hercock was fined $250.
