Evidence:

Following the running of Race 8, the Respondent Jockey Kate Hercock admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).

The Respondent acknowledged she understood the Rule and confirmed  her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

The films of the incident were shown. Stipendiary Steward pointed out that on leaving the stalls  Ms K Hercock angled her mount inwards looking to get a slot closer to the rails. In doing so she placed pressure on Miss Burdan’s mount WEOWNA TIGER causing that Jockey to take hold. There was a little jostling and Miss Burdan had to take some corrective action.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submission for Penalty:

Mr Goodwinn commented that although he classed the incident in the low range the horse concerned did suffer some inconvenience. This was Miss Hercock first breach of the since she returned to race riding he added.

Miss Hercock while admitting the breach did comment that there may have been a little overreaction by Miss Burdan.

Reasons for Penalty:

While the guidelines indicated a 5 day suspension a one day discount to reflect her good record was deemed appropriate

Conclusion – Penalty:

Ms Hercock’s License to ride was suspended from after racing on Saturday,8 January 2022 until completion of racing on Friday, 14 January 2022.  A total of 4 days.
