SUMMARY OF FACTS:

The Information alleged that J Kamaruddin (No Rock No Pop) failed to ride his mount out fully to the finish.

At the outset of the hearing Mr Kamaruddin confirmed that he admitted the breach.

The Rule requires .. A person being the rider of a horse in a race, must ride his horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

Mr Kamaruddin was a replacement Rider for No Rock No Pop after Mr Mudhoo was stood down earlier in the day.

Video footage of the closing stages of the race were shown. Approximately 50 metres from the post No Rock No Pop was in 5th place. Mr Kamaruddin is clearly seen to ease up on his mount with Cross Road (Ms L Hemi) gaining 5th position.

When asked to comment Mr Kamaruddin stated that he/horse were getting tired.

REASON FOR DECISION:

Mr Kamaruddin admitted the breach therefore the charged was deemed proved.

SUBMISSION FOR PENALTY:

Mr Oatham referred to the Penalty Guideline in respect of a breach of this Rule. Starting point for loss of 5th place is $300. Mr Oatham considered that this penalty was appropriate although did comment that the incident was a ‘bad look’.

Ms Clapperton when speaking on behalf of Mr Kamaruddin commented it was his first charge of this type and that his actions were out of character.

REASON FOR PENALTY:

The Committee in deciding penalty do acknowledge that to the best of their knowledge there were no betting pools affected by the loss of 5th place, whilst it is difficult to remain satisfied that the horse would have retained 5th place even if ridden out. However it, remains incumbent on the Rider to ensure that he/she complies with the Rule. We also note a $400 difference in stake money between 5th and 6th.

The Committee determined a $300 fine is appropriate.

CONCLUSIONS:

Mr Joe Kamaruddin is fined $300.
