SUMMARY OF FACTS

Ms Hercock the Rider of MATINEE admitted a breach of Careless Riding in that near the 1300m, she allowed her mount to shift in when not clear.  This resulted in tightening to LINGJUN XIONGFENG, CONGO and OPAL SPIRIT which was checked.

Ms Hercock said that she understood the Rule, charge and confirmed that she admitted the breach.

Mr Goodwin showed film replays and identified all horses involved.

He said that Ms Hercock commenced to shift in towards the running rail and did not quite give the horses to her inside enough room, resulting in Mr Hannam having to take a hold of his mount OPAL SPIRIT.

Ms Hercock said that she was not aware that there were three horses to her inside as she did not see Mr Hannam down on the inside.  She added that if she had have been aware, she would have eased off.

DECISION

As the charge was admitted along with the film evidence the charge was found proved.

PENALTY SUBMISSIONS

Mr Oatham said that Ms Hercock had only one prior breach in the last 12 months, that being on 31 December 2021 when a 4-day suspension was imposed.

He added that it was not an abrupt shift by Ms Hercock and said that the incident occurred on a tricky corner.

Mr Oatham placed the carelessness in the low-end category.

Ms Hercock said that she would like any suspension to commence after 5 March 2022.

REASONS FOR PENALTY

The Adjudicative Committee took into account all matters in relation to penalty which included:

  • Admission of the breach
  • Good record
  • Where the breach occurred (1300m)
  • Low level carelessness
  • Penalty Guide starting point (5-days)

CONCLUSION

Ms Hercock’s Jockey’s Licence was suspended from the end of racing on 5 March through to all racing on 12 March 2022 (4 National Days).
