EVIDENCE:
Ms Algar alleged that Mr Murray failed to make the contracted weight for VAGUE and was replaced.
SUBMISSIONS:
Mr Murray was to ride VAGUE in Race 3 at the carded weight of 55 kg. He was 1.2 kgs over. Mr Murray explained he had been struggling with his weight for a couple of months.
DECISION:
As the charge was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Ms Algar produced his record which showed 2 previous breaches of this Rule in the past 5 weeks. Mr Murray had been fined $100 and $200 on these occasions. Â Ms Algar submitted that a fine was appropriate.
REASON FOR PENALTY:
This is a third breach in a short period of time. The Committee agrees that the matter can be dealt with by way of a fine on this occasion, but notes that both the connections of the horse and those persons investing on it had been inconvenienced by Mr Murray’s inability to ride VAGUE.
CONCLUSION:
Mr Murray is fined the sum of $300.
