SUMMARY OF FACTS:

Following the running of Race 1, the Sir Patrick Hogan 1550, Mr Jones presented an Information alleging that Ms Satherley, the Rider of HEART OF GOLD, which won the race, committed a breach of Rule 638(3)(g)(ii) in that she struck her mount with the whip in 2 consecutive strides over the concluding stage of the race.

The Rule provides that a Rider must not: “strike a horse with a whip in consecutive strides at any stage of the race”.

SUBMISSIONS:

The race film showed that when leading and was close to the finish of the race, Ms Satherley riding vigorously – as she was entitled to do, – used the whip on 2 consecutive strides of her mount, which she was not entitled to do.

REASON FOR DECISION:

As Ms Satherley admitted the breach it was deemed proved.

SUBMISSION FOR PENALTY:

Ms Satherley has 3 previous breaches of the “Whip Rule” for using excessive number of strikes on 10 July 2021, 25 July 2021 and 25 September 2021, for which she was fined amounts of $300, $400 and $500 and was suspended for 5 days for her most recent breach.

Accordingly, although only 2 consecutive strikes, this was Ms Satherley’s 4th breach of Rule 638(3)(g) and falls to be considered with a starting point of 5 plus National Riding Days plus 50% of her share of the stake.

REASON FOR PENALTY:

The Committee considers that a warning only for 2 consecutive strikes would not be a proper application of the Penalty Guide.  It speaks of a starting point for a fourth offence of breach of “the Whip Rule” and although some might say this only refers to excessive number of strikes, this approach would not be what is intended under Rule 638.  Any breach of the Whip Rule 638(3)(g) – whether under sub clause (i) or (ii) – is to be taken into account when recommended starting points are considered.

CONCLUSIONS:

Ms Satherley has riding commitments on 6 November 2021.  Her licence is suspended for 5 National Riding Days to commence at the conclusion of racing on 6 November 2021 until the conclusion of racing on 13 November 2021.  In addition she is fined $150 to reflect 50% of her share of the winning stake.
