Penalty: Apprentice Rider Ruvanesh Muniandy is suspended for 6 days

Background:

Following the running of Race 2, an Information was lodged alleging a breach of Rule 638(1)(d):

‘in that Mr Muniandy permitted his mount ‘JIKON’ to shift inwards shortly after the start when not sufficiently clear of ‘AUREOLA’ (B May) which was checked’.

Mr Muniandy confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach. Present with him was Trainer Steven Prince.

Rule 638(1)(d) provides:

(1) A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be…

(d) careless

Evidence:

Using available film, Mr Oatham identified the incident. Shortly after the race start, Mr Muniandy moved sharply inwards at quite an angle. Towards the end of this move, he came into the line of Mr May on AUREOLA. He was not a length clear at the time. The move caused AUREOLA to check and after checking, didn’t settle.

Mr Muniandy commented that his mount was green, as were a number of horses in the race.

Decision:

As Mr Muniandy admitted the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

Ms Haley outlined that the Respondent’s record has three breaches of Rule 638(1)(d) within the last twelve months. Mr Muniandy has had 164 rides in the last 12 months. He did not comment as to penalty. M Haley submitted the breach sat at the mid range.

Reasons for Penalty:

In setting Penalty, the Adjudicative Committee referred to the current NZTR Guide.  A suspension of 7 days is the starting point for a mid-range breach. The Adjudicative Committee considered the breach to be mid-range.

Mr Muniandy admitted the breach immediately. Also relevant, was his last breach for a similar matter, was 7 months ago and that his mount was green. Taking these matters into account, the Adjudicative Committee considered a 1 day reduction from the starting point was appropriate.

Conclusion:

Mr Muniandy is suspended for 6 NR Days. Mr Muniandy sought a deferment, which was granted.  Suspension is to take effect from close of racing on 1 December 2024, up to and including 11 December 2024.
