EVIDENCE:

Following the running of Race 7, Stipendiary Steward Mrs Veronica Fisher presented an Information alleging a breach of Rule 638(1)(d) by Class B Rider Mr Ruvanesh Muniandy.

Mr Muniandy stated he was conversant with the Rule and Charge and confirmed he admitted the breach. Apprentice Mentor Mr Jason Laking was present to assist.

Stipendiary Steward Mr Mark Davidson identified, on the race video, Mr Muniandy drawn 3 at the 1400m start. He pointed to Mr Muniandy leading the race shortly after the start with THE ENTERTAINER (J Taplin) and NORTIBUTNICE (K Hercock) to his inside. Mr Davidson showed Mr Muniandy shift into the racing line of THE ENTERTAINER, which dictated that horse into NORTIBUTNICE, who was on the rail and checked. He then showed Mr Muniandy, continue to shift inwards towards the rail and check THE ENTERTAINER.

Mr Davidson said, at no stage was Mr Muniandy clear of the two affected horses.

Mr Muniandy and Mr Laking made no submissions.

DECISION:

The Respondent having admitted the breach, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mrs Fisher stated Mr Muniandy has 1 previous breach of the Rule on his record.

1 March 2025 – suspended for 6 days.

Mrs Fisher said Stewards viewed the breach at mid-range and a suspension in line with the Guidelines would be appropriate.

Mr Muniandy said he wished to take his suspension after racing on 28 February at Wingatui.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 7-day starting point for a mid-range breach of the Careless Riding Rule.

Mr Muniandy’s previous breach was nearly 12 months ago and in conjunction with his admittance of the breach, the Adjudicative Committee considers a 6-day suspension to be fair and reasonable in the circumstances of this incident.

CONCLUSION:

Class B Rider Mr Ruvanesh Muniandy is suspended from the conclusion of racing on 28 February, up to and including racing on 8 March 2026.
