Penalty: Apprentice Jockey Ruvanesh Muniandy is fined $500

Mr Davidson alleged that Mr Muniandy struck his mount HALLELUJAH BROTHER with the whip 8 times prior to the 100 metres in Race 2.

Mr Oatham demonstrated on the videos that Mr Muniandy used the whip on 8 occasions before the 100 metres. HALLELUJAH BROTHER finished 4th in the race.

Mr Laking, the Apprentice Mentor, spoke on behalf of Mr Muniandy. He agreed that there were 8 strikes and observed that HALLELUJAH BROTHER had been responding.

Mr Muniandy confirmed Mr Laking’s comments and said that he had not been counting.

Decision

As Mr Muniandy has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced Mr Muniandy’s record which was clear under this Rule. He referred to the $500 starting point in the Penalty Guide.

Mr Laking and Mr Muniandy both acknowledged that this starting point was appropriate.

Reasons for Penalty

Mr Muniandy has used the whip 8 times before the 100 metres. The starting point in the Penalty Guide is a fine of $500. As this incorporates the fact it is a first breach, no reduction is made for record.

Conclusion

Mr Muniandy is fined the sum of $500.
