Penalty: Apprentice Jockey Ruvanesh Muniandy is suspended for 5 days
Mr Davidson alleged that Mr Muniandy allowed his mount SALAAM NAMASTEY in Race 2 to shift ground outwards when not fully clear of PEEKAY which was contacted and forced wider hampering MISS ENZED near the 350 metres.
Ms Algar demonstrated on the videos that Mr Muniandy was racing towards the rear of the field on the home turn when he angled his mount outwards and made contact with Mr Moseley (PEEKAY), who was forced outwards and into the running line of Ms Sutherland (MISS ENZED). She said the Respondent was not his length and another clear. Ms Sutherland had had to steady her horse off the heels of Mr Moseley.
Mr Laking agreed with Ms Algar’s analysis of the incident. He said Mr Muniandy was tracking well at the time. It was an error of judgment to shift outwards on the corner. There were a couple of bumps to Mr Moseley who had been shifted into the line of Ms Sutherland.

As Mr Muniandy has admitted the breach, it is found to be proved.
Submissions as to Penalty
Mr Davidson produced the Respondent’s record, which was very good, with no previous breaches of this Rule. Mr Muniandy has had 46 lifetime rides. Mr Davidson described the breach as low to mid-range, taking into account there had been an unsuccessful protest. He said Mr Muniandy was an inexperienced Rider who had tried to force a run when there never was one.
Mr Laking reiterated the Respondent’s inexperience and that the breach was not intentional.
Mr Muniandy stated he wished the suspension to start immediately.
Reasons for Penalty
Mr Muniandy has shifted ground outwards on the home bend when not his length and another clear of Mr Moseley, who has been bumped and forced into the line of Ms Sutherland. It is a low to mid-range breach and from a 6-day starting point, there is a one-day reduction for admission of the breach and Mr Muniandy’s very good record.
Conclusion
Mr Muniandy is suspended from the end of racing today, Saturday 2 March up to and including 9 March 2024. This is 5 national racing days.
