Penalty: Class A Jockey Mr Brett Murray is suspended for 5 National Riding Days

EVIDENCE:

Following the running of Race 2, the West Fitzroy Apartments Maiden, Mr Davidson filed an Information charging Mr Murray with a breach of Rule 638(3)(b)(ii) excessive use of whip, on his mount TAKEITEASY, prior to the 100 metres mark.

SUBMISSIONS:

Mr Davidson showed the video of the field entering the home straight to identify Mr Murray riding TAKEITEASY which was leading. He counted Mr Murray strike his horse 8 or 9  times prior to the 100 metre mark. Mr Davidson said the ninth strike could well be called on the marker and the Stewards would be happy to accept that.

Mr Murray said he had got it wrong. He said he had given his horse 2 consecutive hits because it, (TAKEITEASY), had taken notice of one of the hurdle jumps positioned just inside the running rail.

REASON FOR DECISION:

Mr Murray admitted the breach and it is therefore found proved.

SUBMISSION FOR PENALTY:

Mr Davidson stated Mr Murray has 2 previous breaches of the Rule in the last 2 months. The first was on 2 July and the second on 6 August where he was fined $300 and $600 respectively. Mr Davidson said as this is his 3rd breach a period of suspension was required.

Mr Murray made no submissions but asked to have any suspension deferred until after racing at Riccarton on Saturday 14th August.

REASON FOR PENALTY:

The Committee find the 3rd breach Guidelines as being inappropriate in this case. We consider, as do the Stewards, the fourth breach Guidelines of a 5-day suspension is a more condign penalty.

Mr Murray’s application for a deferment of suspension is granted.

CONCLUSIONS:

Mr Murray’s licence is suspended for 5 National Riding Days from the conclusion of racing on the 14th August 2021 up to and including racing on the 26 August 2021.
