Penalty: Jockey Brett Murray is suspended for 4 days

Mr Davidson alleged that Mr Murray allowed his mount IRISH BRIGADE in Race 2, to shift ground inwards when not sufficiently clear, dictating AMERICAN CHEVAL (C Campbell) and HELLDANCER (K Williams) in, which crowded and checked LEROY (Mr R Mudhoo).

Miss Haley demonstrated on the videos that not long after the start and when approaching the 1000 metres, Mr Murray shifted inwards dictating AMERICAN CHEVAL and HELLDANCER inwards, which crowded and checked LEROY, which was racing on the rail. There was a concertina effect. Mr Murray was not his length and another clear.

Mr Murray said he was aware Mr Campbell was there and had thought dictating him was “okay”. He was not aware, however, that Mr Mudhoo was to the inside of Mr Campbell and Ms Williams. He acknowledged he had heard yelling when he was shifting ground.

Decision 

As Mr Murray has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which showed a previous breach of this Rule on 25 September at Timaru, when a 7-day suspension was imposed for a mid to high breach. Mr Murray has had 64 rides this season and Mr Davidson described this record as very good. The breach was at the low end, Mr Davidson said, and he noted that Mr Mudhoo had almost read the shift of ground.

Mr Murray stated he accepted Mr Davidson’s submissions and wished the suspension to start after racing today.

Reasons for Penalty

Mr Murray has shifted ground inwards, when not his length and another clear of Mr Campbell. Mr Campbell and Ms Williams, who was racing to the inside of Mr Campbell, were dictated inwards and Mr Mudhoo has had to check his mount as a consequence. Mr Murray was not his length and another clear when he shifted ground.

It is a low range breach and, from a 5-day starting point, there is a one-day reduction for admission of the breach and Mr Murray’s good record.

Conclusion

Mr Murray is suspended from the end of racing today, up to and including 7 December 2024. This is 4 National Riding Days.
