Penalty: Apprentice Jockey Niranjan Parmar is suspended 7 days and fined $225

Mr Davidson alleged that in Race 5, Mr Parmar allowed his mount SENSE OF TIMING to shift outwards near the 50 metres when not sufficiently clear of QUINTABELLE, which was crowded and checked.

Ms Algar demonstrated the incident on the videos. The Respondent was urging his horse over the final 50 metres and shifted ground outwards. She estimated it was some 6 horse widths and pointed out that although Mr Parmar had corrected the horse on one occasion, he had kept using the whip while the horse was still shifting ground. Mr Doyle, who was improving, was tightened and had to check his mount.

Mr Parmar said he had corrected his mount a couple of times. He acknowledged he was aware he was shifting ground.

Mr Laking said it was a Black Type Race and the Respondent was trying to get the best out of his horse. It was going well and Mr Parmar, who was using the whip, was a stride and half too late in getting back on the rein.

Decision

As Mr Parmar has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record which showed that Mr Parmar has had 3 previous breaches of the Careless Riding Rule in the past 12 months. These were all high range, and only this week, Mr Parmar had been suspended for 3½ weeks for causing a fall. He submitted this breach was mid-range.

Mr Laking said Mr Parmar was a sought after Rider and it was just a lack of judgement on this occasion. Mr Parmar had nothing further to add.

Reasons for Penalty

The breach is mid-range. Mr Parmar has shifted wider on the track in the home straight. The movement is some 6 horse widths and Mr Doyle has had to check his mount. The Penalty Guide provides a starting point of a 7-day suspension for such a breach. Mr Parmar ran 3rd in the race. There is a one-day uplift for the fact the race is a Listed Race.  Mr Parmar is a busy Rider with 385 rides this past 12 months. The Adjudicative Committee at Waikato, when imposing Mr Parmar’s 3½ week suspension, described his record as good. With 2 breaches in a week, that description no longer applies, but his record will be regarded as a neutral factor. There is a one-day reduction for Mr Parmar’s ready admission of the breach.

Conclusion:

Mr Parmar is suspended from 8 March until 17 March 2024. This is 7 National Days. He is fined the sum of $225, which is half of his percentage earnings from finishing 3rd in the race.
