Penalty: Class A Rider Niranjan Parmar is fined $350
Following the running of Race 6, Class A Rider Mr Niranjan Parmar admitted by telephone, to a charge of using his whip on his mount THE NEGOTIATOR when out of contention of running in the first five placings.
The charge was filed pursuant to Rule 638(3)(f)(iii) which provides that:
a Rider must not use his whip
when the Rider’s horse is out of contention of running in the first five placings.
Mr Parmar, by telephone to the Senior Stipendiary Steward Mr Dooley and separately to the Adjudicative Committee, conveyed that he understood the nature of the charge, the Rule and admitted the breach.
EVIDENCE
Using available race films, Senior Stipendiary Steward Mr Dooley demonstrated the incident. He identified Mr Parmar’s mount, THE NEGOTIATOR, who was racing near the rear as the field entered the home straight. From the straight entrance to mid-way up the straight, Mr Parmar struck his mount on three occasions. He was never in contention of finishing in the first five placings and finished in 10th place out of 11 horses finishing the race.
DECISION
As Mr Parmar admitted the charge, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refer).
SUBMISSIONS TO PENALTY
Senior Stipendiary Steward Mr Dooley advised that Mr Parmar had a clear record under this Rule, but added that Mr Parmar had also been given a warning for raising his whip above the shoulder on two occasions at the same time and that this was an aggravating factor.
Mr Dooley submitted that the Penalty Guide provides for a $300 (starting point) fine and suggested that an uplift should be applied to reflect the fact that he was given a warning as well as a charge for two separate offences.
Mr Parmar accepted that a fine would be imposed.
REASONS FOR PENALTY
The race films clearly showed that Mr Parmar struck his mount three times when out of contention and it was apparent that it had no chance of finishing in the first five placings, when the strikes were applied.
The Penalty Guide provides for a starting point fine of $300. A $50 uplift is applied to the starting point, due to Mr Parmar receiving a warning for two above shoulder strikes at the same time.
CONCLUSION
Class A Rider Mr Parmar is fined $350.
