Evidence
This charge arises from the running of Race 5. Deputy Chief Stipendiary Steward Mr Jones filed an Information pursuant to Rule 638(1)(d) alleging the Rider of JUST A TIPPLE (N Parmar), permitted his mount to shift inwards when not sufficiently clear of DARING DAME (W Kennedy), which was checked near the 225 metres.
Mr Parmar acknowledged he understood the Rule and confirmed his admission of the breach.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.
Using the available race films, Senior Stipendiary Steward Mr Dooley demonstrated the incident and showed the horses and Riders concerned.
Mr Dooley told the Adjudicative Committee that approaching the 225-metre mark, JUST A TIPPLE was racing near the running rail, with DARING DAME behind. Mr Parmar shifted off the rail momentarily, which created a clear gap for DARING DAME to run into. As Mr Kennedy presented DARING DAME into the gap, Mr Parmar shifted his mount back into the running line of DARING DAME, who was checked. Mr Kennedy had to ease his mount off the heels of JUST A TIPPLE.
Mr Dooley said that Mr Parmar did take belated corrective action, and at the time of the inward shift, JUST A TIPPLE was never the required distance clear of DARING DAME.
In response, Mr Parmar said that the horse in front of him was shifting ground and “things happened very quickly.”
Decision
As Mr Parmar admitted the breach, the Adjudicative Committee found the charge proved.
Submissions for Penalty
Mr Jones said that Mr Parmar has had one previous breach of the Rule in the past 12 Months, from 153 raceday rides. The earlier breach occurred on 20 December 2024 and resulted in a 6-day suspension.
Mr Jones said Stewards assessed the level of carelessness to be in the low range and submitted that any proposed suspension should be commensurate with a low-range penalty.
Mr Parmar sought an 8-day deferment to any proposed suspension, until after racing on 7 December 2025. He had no further submissions concerning penalty.
Reasons for Penalty
After considering the submissions and reviewing the race films, the Adjudicative Committee determined Mr Parmar’s carelessness to be in the low-range and adopted a 5-day starting point.
Mr Parmar allowed his mount to shift out from the rail and then back in, without due consideration for Mr Kennedy’s mount, who was trailing on the rails. As a result, Mr Kennedy had to check his mount off the heels of JUST A TIPPLE.
This is Mr Parmar’s second breach in 12 months. His earlier breach occurred more than 11 months ago. This is a particularly good record. Consequently, due to his admission and record, a 1-day reduction was applied to the 5-day starting point.
Therefore, the Adjudicative Committee decided that a four-day suspension was suitable.
Conclusion
The Adjudicative Committee granted Mr Parmar a deferment to his suspension and his Licence to ride in races is suspended for a period of 4 days, beginning after racing on 7 December 2025 and concluding after racing on 13 December 2025.
