Penalty: Driver, Brent Barclay fined $250
Mr Renault alleged that in Race 1, Mr Barclay (RAKNRUIN) drove carelessly after 100 metres when contacting the sulky wheel of WEHAVTIME, breaking in consequence.
Mr Renault demonstrated on the video that shortly after the start Mr Barclay was endeavouring to slot in behind Mr N Williamson when he clipped the wheel of Mr Williamson’s cart and RAKNRUIN broke as a consequence. RAKNRUIN galloped for 20 or 30 metres, losing ground, before settling on the pole line. There was minor interference to RAKLOU.
Mr Barclay said he was dragging back to get a run behind Mr Williamson and made a misjudgement. He did not believe it had had any impact on RAKNRUIN’s chances in the race as he had followed RAKLOU, which was the best horse in the race.
Decision
As Mr Barclay has admitted the breach, it is found to be proved.
Submissions as to penalty
Mr Renault produced the Respondent’s record which showed that Mr Barclay has had 257 drives this season. He had a clear record. Mr Renault accepted the consequences of the breach were low and submitted it was low-range.
Mr Barclay reiterated he did not believe the incident had affected RAKNRUIN’s chances.
Decision as to penalty
The breach is low-range. Mr Barclay has contacted the wheel of WEHAVTIME shortly after the start when he was shifting inwards to slot in behind Mr Williamson. His horse has galloped briefly as a consequence.
The starting point in the Penalty Guide is a fine of $300. Mr Barclay is a busy Driver, and his record is clear under this Rule. Taking into account record and admission, the penalty is a fine of $250.
