Facts

Following Race 3, The Alex Jenkins Mobile Pace, the Respondent Mr Brent Barclay, admitted a breach of Rule 869(3)(b) careless driving.

The careless driving was passing the 350 metre mark, when when he allowed his horse to come in contact with CAPTAIN BLIGH.

The Respondent said that he understood the Rule, charge and confirmed he admitted the breach.

Stipendiary Steward Miss Haley demonstrated on the video films, and highlighted CONNIE JACCKA moving into a space, striking the wheel of CAPTAIN BLIGH.

Mr Barclay stated his horse was over racing and he tried to prevent any further possible reactions by driving into the space.

Mr Barclay did not dispute the fact that he had struck a wheel.

Decision

As the charge was admitted, it was deemed proved.

Penalty Submissions

Stipendiary Steward, Mr Munro stated that Mr Barclay has had 8097 lifetime drives, 297 last season and 80 this season.

He received a $300 fine on 21 October 2022 for the same breach, but he has not had a suspension since October 2021.

Mr Munro believed the level of carelessness was below mid range.

Mr Barclay highlighted his excellent driving record and did not seek a deferment of penalty. Mr Munro confirmed the Penalty Guide had a starting point as a 3 day suspension.

Reasons for Penalty

The Adjudicative Committee believed the breach was below mid level. Mr Barclay’s outstanding driving record and admittance of the breach, allows for a one day discount.

Conclusion

The Respondent, Mr Barclay, is suspended for two days from the conclusion of racing on 3 March, until the conclusion of racing on 11 March 2023.
