Outcome: Protest Upheld

Penalty: JUSTINE JACCKA disqualified from 4th place

Mr Munro sought the disqualification in Race 1 of horse 1, JUSTINE JACCKA, placed 4th by the Judge as it galloped in excess of 50 metres in the final 200 metres.

Judge’s placings were:

1st – 7 MAD JACK

2nd – 5 CAEN

3rd – 6 HARLEEN QUINZEL

4th – 1 JUSTINE JACCKA

5th – 10 KYLE LOCH

Miss Haley demonstrated on the videos that JUSTINE JACCKA galloped for approximately 70 metres in the home straight.

The connections of JUSTINE JACCKA did not contest the protest.

After viewing the videos, the Committee is satisfied that JUSTINE JACCKA was not in its proper gait for a distance in excess of 50 metres in the final 200 metres. JUSTINE JACCKA was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.

As JUSTINE JACCKA has gained an advantage over the field, it is appropriate that the horse be disqualified.

Amended placings are:

1st – 7 MAD JACK

2nd – 5 CAEN

3rd – 6  HARLEEN QUINZEL

4th – 10 KYLE LOCH

5th – 3 THE POWER BROKER
