SUMMARY OF FACTS:

The Information alleged a breach of Rule 638(3)(g)(i) in that C Jones used his whip excessively in the home straight.

Mr Jones signed the Information confirming he admitted the breach, and Mr Goodwin used the head-on video to show where he struck his horse on 6 occasions prior to the 100m.

DECISION:

Mr Jones admitted the breach, therefore the charge was deemed proved.

SUBMISSION FOR PENALTY:

Mr Goodwin said Mr Jones has a poor record in regards to the whip rule. His record for the last 6 months is as follows:

30/9/21     6 days    6 strikes

16/9/21      5 days    6 strikes

16/9/21      $500      6 strikes

24/5/21      3 days +$2000   6 strikes

The Stewards submission was for a period of suspension.

Ms Clapperton said in her opinion Mr Jones is not using the whip aggressively. She has advised him to put his hands back on the reins after each strike in an effort to help him remain inside the guidelines.

REASON FOR PENALTY:

The Committee had regard to the revised Penalty Guidelines of September 1st 2021 noting that no discount is given for admission of the breach. For a fourth offence the starting point is 5+ national riding days plus 50% 0f jockey share of stake. Mr Jones has an unenviable record, and as a result is being mentored and aided by Ms Clapperton.  This is his 5th breach in 6 months and while all have been low end (only one strike over the five allowed) a further period of suspension is inevitable. An appropriate penalty today is one of a 6 day suspension.

Mr Jones finished 4th in the race today but due to his apprentice status and the small amount he earned from his share of stake money no monetary penalty was applied.

CONCLUSION:

Mr Jones is suspended from the close of racing on Saturday November 6th up to and including racing on Sunday November 14th, 2021
