FACTS

Mr Jones the Rider of “FAST FLYIN BILLIE” admitted a breach of Rule 638(3)(f)(iii).

The charge was that Mr Jones used his whip when his mount was out of contention.

Mr Jones said that he understood the Rule, Charge and confirmed that he admitted the breach.

Mr Dooley showed film replays and identified “FAST FLYIN BILLIE” back in last position approaching the home straight.

When in the final straight Mr Jones commenced to use his whip in the left hand and at the conclusion of the race he had struck his mount a number of times.

During the run down the straight “FAST FLYIN BILLIE” stayed towards the back of the field.

Mr Jones said that he tried to beat some home and that he used the whip a bit too much.  He added that when the horse last raced the rider sat up and he was asked to try it out.

Ms Dalley confirmed that he (Mr Jones) was asked by Connections to give the horse a fair go and that he gave it one too many.

DECISION

As the charge was admitted it was found proved.

PENALTY SUBMISSIONS

Mr Dooley said that Mr Jones had a clear record under this particular section of the Whip Rule, but advised that Mr Jones had three other breaches of the Whip Rule:

18.05.22 – $250 fine

22.06.22 – $250 fine

25.06.22 – $400 fine

Mr Dooley said an aggravating feature was the number of strikes applied.

As there is not a starting point for this particular breach, Mr Dooley suggested a starting point of a $400 fine.

REASONS FOR PENALTY

Mr Jones overall whip record is not good and a $400 starting point was adopted.

Giving due consideration to all matters, the starting point penalty was considered appropriate.

PENALTY

Mr Jones was fined $400.
