SUMMARY OF FACTS:

The Information alleged a breach of Rule 638 (g)(i) in that C Jones (Millie Georgia) used his whip excessively in the home straight.

At the outset of the hearing Mr Jones confirmed he understood the Rule and admitted the breach. Assisting him was Ms K Clapperton – Central Districts Apprentice Mentor – who also confirmed this.

Mr Goodwin played video of the race. Mr Jones struck his mount on 6 occasions  from the point of the home turn to the 100 metre mark. His horse was well beaten and finished last.  Mr Jones did not offer comment on the incident other than noting that his helmet had moved which impaired vision.

REASON FOR DECISION:

Mr Jones admitted the breach, therefore the charge was deemed proved.

SUBMISSION FOR PENALTY:

Mr Goodwin produced Mr Jones’ record under this Rule.

In effect this is Mr Jones’ 5th offence under this Rule within the last six months.  Mr Goodwin sought penalty in line with the revised Penalty Guidelines and also asked that Mr Jones be referred to the Riding Master for guidance in respect to his whip use.

Mr Jones sought deferment of penalty to honor riding commitments.

REASON FOR PENALTY:

Guidelines effective 1st September 2021 illustrate 4th offence starting point at 5 plus days plus 50% of Jockey share of stake. Given the  circumstances an uplift is appropriate. Ms Clapperton has also given an undertaking to mentor Mr Jones in respect of his whip use.

CONCLUSIONS:

Accordingly Mr Jones is suspended for 6 NR days from the conclusion of racing on 9th October 2021 up to and including 17th October 2021.
