SUMMARY OF FACTS:

Following the running of Race 4, the Cavallo Farm & Chris Rutten Bloodstock Handicap 1600, Mr K Coppins presented an Information charging Apprentice Jockey Mr C Jones with a breach of Rule 638(3)(g)(i) in that he struck his horse, GOBUYIT to an extent which was excessive.

SUBMISSIONS:

The facts were, as evident from the race film and illustrated by Mr Goodwin and Mr Coppins, that Mr Jones struck his mount 6 times with the whip prior to reaching the 100 metre mark.  GOBUYIT finished 4th and earned a stake of $600, of which Rider share was $30.

REASON FOR DECISION:

As Mr Jones admitted the charge, it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Coppins advised that Mr Jones had a previous breach of this Rule since 27 May 2021 for which he was suspended for 3 National Riding Days.  Mr Jones accepted that the revised Guidelines, since 1 September 2021, should apply.

REASON FOR PENALTY:

For this second offence, the starting point Guideline is the greater of $500 or 50% of a Jockey’s share of any stake obtained.  As an Apprentice Jockey Mr Jones would receive only $15 (being his half share of the 50% stake obtained).

CONCLUSIONS:

Accordingly a fine of $500 is imposed, there being no aggravating or mitigating factors.
