EVIDENCE:

Mr A Sharrock, the Trainer of EIZUS in Race 4, the “CONTEMPORARY KOROWAI DESIGNS 1600”, did not declare a Rider for that horse by the time required by the NZTR.

Following on from the scratching of OUR GIULIA, for which Mr Hashizume was the declared Rider, Mr Sharrock then engaged that Rider to ride EIZUS.

As a result, there was a late Rider declaration, in breach of Rule 537(a), which requires a Trainer to declare to the NZTR the name of the Rider of a horse accepted for a race by the time and date specified by the NZTR.

Mr Sharrock admitted the charge presented by Mr Goodwin.  He said he had first telephoned NZTR to advise that he wished to declare Mr Hashizume as his Rider for EIZUS, but was told that that Rider had another mount.  It so happened that when Mr Hashizume’s mount was scratched, Mr Sharrock secured him to ride EIZUS.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

For a first or second breach of this Rule, a Trainer may be dealt with under the “Minor Infringement” process and fined $50 (first offence) or $100 (second offence).

But this was Mr Sharrock’s third breach of this Rule, and thus he had to face this Information.

REASONS FOR PENALTY:

Mr Sharrock, when told that Mr Hashizume was already declared as Rider of OUR GIULIA, he waited – no doubt to hope for a scratching.

Mr Sharrock is fined $200 for this third breach, as his 2 previous breaches are aggravating factors.

CONCLUSION:

A fine of $200 was imposed.
