SUMMARY OF FACTS:

Prior to Race 1, Senior Stipendiary Steward Mr Goodwin lodged an Information alleging a breach of Rule 534(2)(b) in that Licenced Trainer Allan Sharrock failed to scratch TULLAMORE DEW (Race 2) and EL JAYCEE (Race 5) by the required time.

The Respondent was not present on course. Senior Stipendiary Steward Mr Goodwin was asked by the Respondent to endorse the Information. It was conveyed that he admitted the breach, but was unable to attend a hearing. Given circumstance, the Adjudicative Committee was satisfied to proceed on this basis.

EVIDENCE:

Mr Goodwin advised that Mr Sharrock had provided his submission via phone. Stewards confirmed that Mr Sharrock was outside phone coverage prior to deadline. On accessing track information, Mr Sharrock immediately contacted Stewards to advise of his decision to scratch. This was 8.26am on race morning.

DECISION:

Mr Sharrock admitted the breach, therefore the charge was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Goodwin submitted that no horses were denied a run or disadvantaged due to the breach. The Respondent readily admitted the breach, whilst his record remains clear. The Adjudicative Committee was referred to the current NZTR Penalty Guide.

REASONS FOR PENALTY:

The Penalty Guide provides for a fine of $200 for a breach of this Rule in circumstances where no other runner(s) are affected. Mr Sharrock’s explanation was noted. In this instance, the Adjudicative Committee determined there were no compelling reasons to deviate from the Penalty Guide.

CONCLUSION:

Licenced Trainer Mr Allan Sharrock is fined $200.
