Evidence:
The Applicant, Chief Stipendiary Steward Mr Oatham filed an Information pursuant to Rule 330(3)(c) alleging that Class A Rider, Ryan Elliot failed to make the contracted weight for his mount MONTEZUMA (Race 1).
The Respondent was present at the hearing and confirmed his admission of the breach.
Rule 330(3)(c) provides:
“A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Oatham advised that about 1 hour prior to Race One the Connections of MONTEZUMA sought permission to replace its Rider from Mr Elliot to Apprentice Rider, Mr R Beemud. The request was because Mr Elliot was unable to make MONTEZUMA’s handicapped weight of 57.5 kg.
Mr Oatham advised that although it was not ideal that Mr Elliot, a senior Rider, be replaced by a 3kg claiming Apprentice Rider, the replacement request was granted due to there being no other suitable Riders available at weigh-out time.
Mr Elliot agreed with the facts and offered no further explanation.
Decision:
As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.
Submission for Penalty:
Mr Oatham said that this is the Respondent’s fifth breach of the Rule within the last 120 days, and his seventh since 18 February 2022. He said that Mr Elliot’s poor record in relation to this Rule is of real concern to Stewards.
Mr Oatham said that his most recent breach was at the Taumaranui meeting on 30 July 2022 and resulted in a 4-day suspension. He said given his recent record another suspension is necessary.
Mr Elliot advised that he could commence any proposed suspension immediately. He added that he has recently returned from a holiday and is struggling to get his weight under control.
Reasons for Penalty:
The MIN schedule establishes a $100 fine as the starting point for a first breach of this Rule. In circumstances where Stewards elect to file an Information, determination of penalties are fact dependent.
The Adjudicative Committee considered the submissions and for consistency, took some guidance from previous penalties for similar breaches.
Given the circumstances and balancing the interests of the Respondent including his poor record; and the interests of all Stakeholders, the Adjudicative Committee determined a 5-day suspension to be an appropriate penalty.
Penalty:
Mr Elliot’s Licence to ride in races is suspended from close of racing on 27 August 2022 until close of racing on 4 September 2022 (5 national days).
