Evidence:

Prior to Race 1, Stipendiary Steward Ms Veronica Algar filed the aforementioned Information under Rule 330(3)(c) alleging that Class A Rider Ryan Elliot failed to make the contracted weight for his 6 mounts at the Wanganui Jockey Club meeting on 11 January 2024.

Mr Elliot was not on course and ‘attended’ the hearing by way of mobile. He confirmed his admission of the breach.

Rule 330(3)(c) provides:

“A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.

Ms Algar advised that Mr Elliot had contacted Stewards at approximately 7am on the morning of the races to inform Officials that he was unable to make the carded weight for his 6 mounts. Replacement Riders were then confirmed for all mounts.

When asked, Mr Elliot commented that he had tried to get his weight down, had been for a run the day before the meeting and had rode work on the morning of the races.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Ms Algar advised that this is Mr Elliot’s 4th breach within a 120 day period, whilst noting that he continues to struggle with his weight. Stewards sought penalty by way of a suspension. Mr Elliot did not comment beyond asking that if a suspension was imposed, that it starts after the ATR Meeting at Ellerslie on 14 January 2024.

Reasons for Penalty:

The existing MIN schedule provides for a $100 fine as the starting point for a first breach of this Rule. Where an Information is lodged, then determination of penalty remains fact dependent. The Adjudicative Committee considered submissions and sought guidance from previous penalties. Whilst acknowledging that a breach of this Rule is generally dealt with by way of a fine, circumstances dictate that this breach requires imposition of a suspension.

Conclusion:

Mr Elliot’s Licence to ride in races is suspended for 4 NR days, from the the close of racing on 14 January 2024, up to and including, 21 January 2024.
