Penalty: Jockey Ryan Elliot is fined $250

Evidence:

Following the running of Race 9, the “Coca-Cola Canterbury Gold Cup”, Mr Oatham presented an Information charging Mr Elliot, the Rider of “PLATINUM INVADOR” with a breach of the Whip Rule [638(3)(g)(i)], in that he struck his mount with the whip 6 times prior to the 100 metres mark.

Mr Elliot admitted the breach and as he had transport commitments, advised that he did not wish to be heard, and that he accepted his error.

The race film illustrated the error of one use of the whip, over that permitted, as the horse was mounting a strong run, and eventually finished 4th.

Decision:

As the breach was admitted, it was deemed proved.

Submissions for Penalty:

Mr Oatham advised that because this was a Group 3 Black Type Race, the Penalty Guide required (for 1 additional strike), a starting point equal to 50% share of the Rider’s share of the stake or $250 whichever is the greater, together with the possibility (but not certainty) of a suspension.

He did not consider suspension necessary and the Adjudicative Committee also does not regard it as appropriate.

Reasons for Penalty:

The stake earned by “PLATINUM INVADOR” for finishing 4th was $5,000, so Mr Elliot’s % amounts to $250 with one half of that being $125.  So that provision does not apply.

Conclusion:

Accordingly, Mr Elliot is fined $250.
