Penalty: Jockey Ryan Elliot is suspended for 4 National Riding Days

Evidence:

Mr Jones presented an Information charging Mr Elliot with a breach of Rule 330(3)(c) of failing to make his required weight (of 57kg) to ride the horse LYCOMEDES in Race 6, the COURTESY FORD RYDER STAKES.

Prior to racing, at about 10am, Mr Elliot advised the Informant Stipendiary Steward, that he was unable to make his contracted weight of 57kg for the mount LYCOMEDES in the Listed COURTESY FORD RYDER STAKES.  He has ascertained that Mr V Colgan, a frequent Rider for horses of Trainers Mr R James and Mr R Wellwood, was available to ride that mount.  As a result Mr Colgan rode LYCOMEDES which finished 3rd.

Decision:

As Mr Elliot admitted the breach, it is deemed proved.

Submissions for Penalty:

Mr Elliot had 3 previous recent breaches of this Rule, namely on 23 April, 7 June and 11 June 2022 when he had been fined $400.

Mr Jones submitted that as Mr Elliot’s struggle with his weight over the past year, which has led to 8 breaches of the Rule, and that this was a Listed Race, a suspension was a realistic option.

Mr Elliot explained that he had done his utmost to make the weight but it being winter, and he having had influenza and health difficulties, it had been impossible to achieve 57kg.

Reasons for Penalty:

Mr Elliot has had 3 previous breaches of this Rule in the past 6 months, and his weight struggle has led to 8 charges over the past year.  He is a senior successful Rider who genuinely tries to meet his weight commitments.  But he can no longer be subject to a fine only, especially where as here this was a Listed Race and he was contracted to ride a promising horse (which in fact ran 3rd).

Conclusion:

His licence is suspended for 4 National Riding Days, being from 7 August 2022 (Hawera) to 13 August 2022 (Canterbury) inclusive.
