Penalty: Class A Rider, Terry Moseley is fined $250

Evidence:

Following the running of Race 6 Mr Oatham presented an Information alleging a breach of the Whip Regulations by Terry Moseley.

Mr Oatham identified Mr Moseley on the video replay and pointed to him striking his horse 6 times in the final straight.

Mr Moseley confirmed he was conversant with the Rule, he understood the charge, and he admitted the breach.

Submissions on Penalty:

Mr Oatham stated Mr Moseley had a clear record under the Rule but as this was a Black Type race a warning was not appropriate. He said Mr Moseley’s percentage from the race was approximately $160, 50% of which is $80. He said the Penalty Guidelines state the greater of either Mr Moseley’s share of the stake or a $250 fine is the appropriate Penalty.

Reasons for Penalty:

The Adjudicative Committee found Mr Oatham’s calculations to be correct and accordingly fined Mr Moseley $250.

Conclusion:

Class A Rider, Mr Terry Moseley is fined $250.
