Mr Davidson alleged that in Race 9 Mr Moseley (SARAYU) rode carelessly when he permitted his mount to shift inwards crowding GRANITE RIDGE (Mr Mudhoo) near the 1300 metres.
Mr Davidson demonstrated on the films that Mr Moseley was back of midfield at the 1300 metres. Mr Moseley shifted inwards, crowding and checking Mr Mudhoo. He pointed out that Mr Moseley turned the head of his horse inwards towards Mr Mudhoo at the time of the check.
Mr Moseley said Mr Davidson’s analysis of the films was correct. They were going around the corner and he knew Mr Mudhoo was inside of him, and he thought he was clear when he shifted. He accepted he was not, and that Mr Mudhoo was entitled to be there. There was just a stride in it. He believed the breach was low end.
As Mr Moseley has admitted the breach, it is found to be proved.
Mr Davidson produced the Respondent’s record which showed two breaches of this Rule in the past 12 months. Mr Davidson described this record as reasonably good and said the Stewards were of the view the breach was low to mid-range.
Mr Moseley reiterated that he believed the interference was at the lower end. He asked the Adjudicative Committee to take into account his record and that he had admitted the breach. He did not seek a deferment of the penalty.
The Adjudicative Committee believes that the breach is low to mid-range. Mr Moseley has shifted inwards on the track and crowded Mr Mudhoo who has had to check. The obligation on Mr Moseley is to be his length and another clear. He was not when he shifted ground.
The Adjudicative Committee takes a starting point of 6 days. Mr Moseley is an experienced Rider who has had 505 rides this season. This is his third breach in a 12-month period. He is a busy South Island Rider and, viewed in that light, his record is good. A day’s credit is appropriate for this and his early admission of the breach.
Mr Moseley’s licence is suspended for 5 days. This is from the end of racing today 12 June, up to and including 22 June 2022.
