BACKGROUND:

Following the running of Race 2, Mid Winter Christmas – 24 June Rating 75, Class A Jockey, Terry Moseley, as the Rider of COLOSSAL in the race, admitted a breach of failing to ride his mount out to the finish when there was a reasonable chance of finishing in 5th place, being beaten by a nose.

The Rule provides:

636 (1)   A person:

(d)     being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

EVIDENCE:

Chief Stipendiary Steward, John Oatham, showed a video replay of the final stages of the race. He had Steward Mark Davidson, point out COLOSSAL, ridden by the Respondent, which had led, in 4th position nearing the finishing line. Mr Davidson then showed that the Respondent had been riding his mount out until, “two and a half strides” from the line, when his posture changed and VAGUE (Gosen Jogoo) got up to beat it for 5th placing, the margin being “a very close nose”, Mr Davidson said.

The Respondent said that his horse had come to the end of its run, but he accepted that he had a responsibility to ride it out to the finish. It did not look good, he said.

DECISION:

The charge having been admitted, it is deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham said that the Respondent has a clear record under the Rule. There was a difference in prize money of $300 between 5th ($750) and 6th ($450), he said. The Penalty Guide specifies a starting point of a $300 fine for a breach of the Rule and Stewards see no reason to depart from that starting point, Mr Oatham said.

The Respondent said that that sounded fair.

REASONS FOR PENALTY:

The Adjudicative Committee noted the provisions of the RIB Thoroughbred Racing Penalty Guide (February 2023) which provides that “the starting point relates to the potential placing deemed to have been lost as a result of the breach”.  In this case, the placing lost was 5th and the Guide specifies a starting point of a $300 fine.

The Adjudicative Committee decided that a fine of $300 was an appropriate penalty.

CONCLUSION:

The Respondent, Class A Jockey, Terry Moseley, is fined $300.
